Prize Event Parkwood Karting : Terms and Conditions
1. These Terms and Conditions together with any specific rules set out in Competition Notices, (as defined below), are the Competition Rules ("the Rules") and apply to all Competitions, (as defined below), on the website www.deltaprize.com, www.deltaprize.co.uk ("the Website"), unless otherwise expressly stated. By entering a Competition, Entrants, (as defined below), agree to be bound by these Rules.
DEFINITIONS:
2. Charity:
A Charity or Charities that are registered with the Charity Commission and that will be chosen by the Promoters from time to time and displayed on the Website.
3. Closing Date:
The closing date for the Competition as advertised on the Website at the date of the Competition Entry.
4. Competition(s):
The Competition organised by the Operators to which these Rules apply.
5. Competition Entry:
An answer to the question submitted by the Entrant together with the Cost of Entry and name, postal address, telephone number and email address of the Entrant submitted via the Website.
6. Competition Notice:
Should there be any Rules specific to each Competition these will be displayed on a notice on the page for such Competition and are incorporated into the Rules. In the event of discrepancy between these Terms and Conditions and the Competition Notice, the Competition Notice shall prevail.
7. Competition Winner:
The Entrant whose correct Competition Entry shall be chosen at random in the Prize Draw.
8. Cost of Entry:
£5.00 (Five Pounds)
9. Entrant:
Any person aged 18 years or over who enters the Competition through the Website to have an opportunity to win the Prize other than Employees of the Operators, Promoters or any company involved in the Competition or any advertising agency or web company connected with the Operators or Promoters any such person's subsidiary or associated companies, agents or members of their families or households.
10. Entry Fees:
The total number of entries sold multiplied by the Cost of Entry.
11. Maximum Number of Entries:
150 (One hundred and fifty)
12. Opening Date:
The opening date for the Competition as advertised on the Website at the date of the Competition Entry.
13. Operators:
The DeltaPrize team who organise the running of the Competition on behalf of the Promoters.
14. Promoters:
The Competition is operated by the following Promoters;-

15. Operators' Solicitors:
Langleys Solicitors of Olympic House, Doddington Road, Lincoln, LN6 3SE
16. Prize:
One of the properties that will from time to time be advertised and described on the Website, and which on or before the Prize Draw the Operators shall in their absolute discretion decide will be the Prize.
17. Prize Draw:
The Prize Draw will be held within 28 days of the Closing Date and will be a random number generated draw. It will be held publicly in the presence of a representative of the Operators Solicitors.
18. Question:
The Question which shall be posted on the Website by the Operators in relation to the Competition that the Entrants must answer correctly in order to be entered into the Prize Draw.
GENERAL
19. The Promoters reserve the right to cancel or amend the Competition or the Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside the Promoters reasonable control. Any changes will be posted either within these Terms and Conditions or the Competition Notice. If the Promoters cancels the Competition then they will return the entry fees to each Entrant.
20. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to a Competition, the decision of the Operators shall be final and no correspondence or discussion shall be entered into.
21. The Consumer Protection (Distance Selling) Regulations 2000 shall not apply to any Competition.
22. The Promoters will donate from each Competition a percentage of the gross entry fees to Charity such percentage to be notified on the Competition Notice.
23. The Entry Fees shall be transferred weekly from the Promoters payment provision account to a bank escrow account in the Promoters' names but governed by the Operators' Solicitors until the Prize draw.
QUALIFYING ENTRANTS
24. Additional eligibility requirements may apply to a specific Competition. These will be set out in the Competition Notice.
25. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. The Operators reserve the right to verify the eligibility of all Entrants.
26. The address you provide with your Competition Entry will be used to send any notice of Prizes so please ensure it is correct. You are not entitled to enter the Competition if you are resident in a country or jurisdiction (outside the United Kingdom or Republic of Ireland) where the Competition may breach any law or regulation. Where this applies, the Operators invitation to enter the Competition in such country and/or jurisdiction is withdrawn.
27. This Competition is open to persons aged 18 or over only. The Operators assume that by using the Website and entering the Competition, (and you warrant that), you are aged 18 or over.
28. The Operators reserve the right to disqualify any Entrant if it has reasonable grounds to believe the Entrant has breached any of the Rules.
29. In the event that any Entrant is disqualified from the Competition, the Operators in their sole discretion may decide whether a replacement should be selected. In this event, any further Entrant will be selected on the same criteria as the original Entrant and will be subject to these Rules.
COMPETITION ENTRIES
30. You may enter the Competition as many times as you like however where a Competition Winner has been selected and the Operators discover or have reasonable grounds to believe the Competition Winner has used any software or automated process either to answer Questions or to make bulk Entries, the Operators may select an alternative Competition Winner. Any further Competition Winner will be selected on the same criteria as the original Competition Winner and will be subject to these Rules.
31. Competition Entries must be made in the manner and by the Closing Date and time specified in these Terms and Conditions or on the Competition Notice which ever may be applicable to the Prize. Failure to do so will disqualify the Entry.
32. There is no charge to register for use of the Website.
33. Proof of posting or emailing cannot be accepted as proof of delivery. The Operators or Promoters cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside the Operators or Promoters control.
34. The Operators do not accept responsibility for the return of any Entries.
35. After Entrants make their Entry to the Competition they will receive an e-mail as soon as reasonably practicable informing them if they have the correct answer to the Question. If so, they will be given a number which shall be entered into the Prize Draw. It is the responsibility of the Entrant to keep a copy of this e-mail.
36. All Entrants acknowledge that making a Competition Entry does not guarantee in any way that they will win the Prize.
37. It is the sole responsibility of each Entrant to retain a copy of the confirmatory e-mail with their unique number for their future reference.
38. When the earlier of Maximum Number of Entries or the Closing Date is reached, the Competition will closed but for the avoidance of doubt where the closing date has been reached but the Maximum Number of Entries has not been reached the Operators reserve the right to extend the Closing Date by 3 months.
39. The Competition Entry may only be submitted in English and not any other language.
40. All payments forming part of the Competition Entry to be made on the Website via the 'DIRECT BANKING', 'INPAY', 'PAYPAL' or 'REGONLINE' facility.
41. Once a Competition Entry has been submitted the Promoters shall not be required to make a refund except in the circumstances set out in Clause 19.
PRIZES
42. Competition Winners will be chosen at random in the Prize Draw. In all matters, the decision of the Operators shall be final and no correspondence or discussion shall be entered into.
43. Competition Winners will be notified in the manner and within the time specified on the Competition Notice. Return of any Prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. The Competition Winner(s) picture and name will be published on the Website.
44. Claims for Prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a Prize within this time or in the manner specified may result in disqualification and selection of an alternate Competition Winner.
45. The Prize is non-transferable and there is no cash alternative.
46. The Prize will be awarded at the Operators discretion. No Prize will be awarded as a result of improper actions by or on behalf of any Entrant.
47. The Competition Winner must, within the time specified on the Competition Notice of the Operators notifying them of their win, provide the Promoters with proof of identification in the form of an up to date passport or full driving licence, and a copy of the winning email.
If the above is not supplied within the specified timescale the Competition Winner shall lose the right to claim the Prize and the Operators may select an alternative Competition Winner. Any further Competition Winner will be selected on the same criteria as the original Competition Winner and will be subject to these Rules.
48. The Promoters in no way personally offer any warranty relating to the condition of the Prize.
49. If the Operators cannot contact the Competition Winner within 21 days of the Prize Draw using the contact details that formed part of their Competition Entry, the Operators shall be entitled to select an alternative Competition Winner. Any further Competition Winner will be selected on the same criteria as the original Competition Winner and will be subject to these Rules.
CLOSING THE COMPETITION
50. If the Maximum Number of Entries does not subject to Clause 36 reach that specified in the Rules, the Competition will close.
51. The Competition Winner shall still be determined in accordance with these Rules. In the Rules if the Maximum Number of Entries does not reach that specified then the Competition Winner shall be awarded the Entry Fees less 25% to cover the Operators administration and marketing costs ('the Prize Fund').
USE OF ENTRIES
52. The Operators shall use your Entry for no other purpose than the orderly conduct of the Competition. Any personal data relating to Entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the prior consent.
LIABILITY
53. The Operators or Promoters cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Entrant entering the Competition or as a result of accepting the Prize. The Operators or Promoters are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or Entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to Entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition.
54. The Operators accept no liability for errors or omissions contained within the Website. It is the responsibility of each Entrant to satisfy themselves as to the accuracy of any such content.
JURISDICTION
55. The Competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. The Website is only intended to be accessed from the United Kingdom. The Operators make no representations that materials on the Website relating to this Competition are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Website outside of the United Kingdom, you are responsible for compliance with all local laws.
56. By making a Competition Entry each Entrant confirms that they have read and understood these Rules.
